Superior adopts nuisance rule for unsecured pits near rights-of-way
A July 13 ordinance declares uncovered pits and excavations below adjacent street, sidewalk or other right-of-way grade a nuisance unless they are covered or fenced.

Superior Town Council adopted Ordinance O-17 Series 2026 on July 13, creating a nuisance category for unsecured open pits and excavations below the grade of an adjacent right-of-way.
Under the ordinance, those depressions, pits or excavations are a nuisance unless they are covered with a locked lid or other cover weighing at least 60 pounds, or enclosed by a solid fence at least five feet high.
The public meeting record reviewed for this story does not identify a specific injury, complaint or site that prompted the change. The ordinance applies townwide rather than to a named property.
It takes effect 10 days after publication.
The materials reviewed do not spell out inspection, notice, abatement or penalty procedures beyond the nuisance declaration itself.
