Louisville City Council approved an amendment Nov. 2 that would extend Ripple Creek Properties LLC’s review period for two City-owned properties on Empire Road from 60 to 150 days. The properties are at 1501 Empire Road and the easterly portion of 1303 Empire Road, near the city’s wastewater treatment plant. The [council approved the amendment in Resolution No. 110](https://louisvilleco.api.civicclerk.com/v1/Meetings/GetAttachmentFile(fileId=5825), authorizing the mayor to sign it with limited revisions.
The review period runs from the purchase contract’s effective date. Under the [original contract](https://louisvilleco.api.civicclerk.com/v1/Meetings/GetAttachmentFile(fileId=5827), the buyer may terminate during the examination period and recover its $50,000 earnest-money deposit. The contract sets closing within 160 days of its effective date, with a possible extension of up to 90 days if specified sale conditions remain outstanding. The amendment leaves those closing terms unchanged; if signed, the 150-day review period would leave 10 days before the scheduled closing deadline, absent another applicable extension. A separate contract provision allows up to 30 additional days for the examination period if an initial environmental assessment recommends further investigation.
The proposed amendment sets its effective time as 4:59 p.m. Nov. 2. The copy in the Council packet has blank date and signature lines, so it does not establish whether both parties executed the amendment.
